Privacy Policy

Last updated 10 September 2026. This policy explains how Life & Memories handles personal information when families create, purchase and share tribute projects.

Life & Memories is operated from France and offers services to customers in New Zealand and Australia. We apply the New Zealand Privacy Act 2020 and, where applicable, the Australian Privacy Act 1988 and Australian Privacy Principles.

1. Who we are

Life & Memories is the organisation responsible for the personal information described in this policy. Our privacy contact is info@lifeandmemories.co.nz.

This policy covers our website, checkout, private tribute-creation space, video delivery and customer support.

2. What we collect

  • Purchaser and account details: name, email, country, order, package and support correspondence.
  • Payment information: payment status and transaction references. Card details are handled by the payment provider and are not intended to be stored by us.
  • Tribute material: names, dates, relationships, photographs, video, audio, music, captions, stories and service details.
  • Technical information: device, browser, IP address, security logs and essential cookies or local storage needed to operate and protect the service.

Tribute material may reveal sensitive or deeply personal information. Please provide only what is needed and what you are authorised to share.

3. Why and how we use information

We use information to process orders; create, review and deliver tribute videos; communicate about the project; prevent misuse; meet legal and accounting obligations; and improve service reliability.

Providing purchaser contact and project information is voluntary, but without it we may be unable to create or deliver the service. We do not sell personal information or use private tribute material for advertising.

4. Sharing and overseas processing

We share information only where reasonably needed with the purchaser and with trusted providers supporting payments, hosting, storage, email, security, video rendering and customer support. We may also disclose information where required by law or to protect people, rights or service security.

Because Life & Memories operates internationally, information may be processed in New Zealand, Australia, France, the European Union, the United States or another location used by an approved service provider. We will assess providers and use contractual or other safeguards appropriate to the information and applicable law. A current list of material providers and processing locations is available on request.

If someone submits information about another living person, the submitter must have authority to do so and should make that person aware of this policy where reasonably practicable.

5. How long we keep information

Active project material is retained while the tribute is being created. The private final-video delivery link is available for 30 days. Working uploads and production files are ordinarily deleted within 90 days after final delivery, subject to backup cycles and any support, dispute, fraud-prevention or legal need. Backups may persist for up to a further 90 days before secure deletion or overwrite. Transaction and accounting records may be kept for the period required by law.

6. Access, correction and deletion

You may ask for access to, or correction of, personal information we hold about you. You may also request deletion or restriction where available under applicable law. We may need to confirm your identity and authority, particularly where a request affects another family member or a shared tribute.

7. Security and privacy incidents

We use reasonable technical and organisational safeguards, limit access to people and providers who need it, and use private project links and owner moderation. No online system is completely risk-free, so customers should protect project links and account credentials.

If a privacy breach is likely to cause serious harm, we will notify affected people and the relevant regulator as required. In New Zealand, serious breaches must be notified as soon as practicable; in Australia, eligible breaches are handled under the Notifiable Data Breaches scheme where it applies.

8. Questions and complaints

Email info@lifeandmemories.co.nz with “Privacy” in the subject. We will acknowledge the complaint and aim to provide a substantive response within 20 working days.

If we cannot resolve it, New Zealand individuals may contact the Office of the Privacy Commissioner. Australian individuals may contact the Office of the Australian Information Commissioner.
